We strive to provide reliable, uninterrupted Services, but cannot guarantee 100% availability. Scheduled maintenance, updates, or unforeseen technical issues may result in temporary interruptions. We will make reasonable efforts to provide advance notice of planned maintenance.
Service availability varies by service tier and subscription plan. Details about service levels and uptime commitments are specified in your service agreement.
Access to certain features requires payment of fees as specified in your subscription plan. All fees are non-refundable unless otherwise stated in a written agreement. We reserve the right to modify pricing with 30 days advance notice.

Both parties agree to maintain confidentiality of proprietary information received from the other party. This includes technical data, business strategies, financial information, customer lists, and energy consumption data. This obligation survives termination of these Terms for five years.
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will meet your specific requirements, be uninterrupted, secure, or error-free, or that results obtained will be accurate or reliable.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECO SAVER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Eco Saver from claims arising from your violation of these Terms, your misuse of the Services, content you submit, or your infringement of third-party rights.
Either party may terminate these Terms at any time. We may terminate or suspend your access immediately for violations of these Terms, fraudulent or illegal activity, non-payment, or extended inactivity. Upon termination, your right to use the Services ceases immediately.
These Terms shall be governed by the laws of the State of Colorado, without regard to conflict of law principles. Disputes shall be resolved through binding arbitration in Boulder, Colorado. You agree to waive participation in class actions.
